A new Dubai villa carries two separate warranties that most owners never see spelled out: a one-year defects liability period for snagging and installation faults, and a ten-year structural liability under Article 880 of the UAE Civil Code. Knowing which one still covers a problem is what decides whether you claim it or pay for it.
They are different in length, scope and who you claim from. The defects liability period, usually one year from handover, is a contractual window in which the developer fixes installation and finishing faults at no cost to you: a door that binds, a leaking trap, tiling that lifted, an AC that was never balanced. The ten-year structural liability, often called decennial liability, sits in law rather than in your contract and covers defects that threaten the safety or structural integrity of the building. The parties who designed and built it carry it whether or not it is written into your sale agreement.

Less time than the ten years suggests, because the clock that matters runs from discovery. A decennial claim is generally time-barred three years after the defect is discovered or the damage appears, not three years after handover. So a crack found in year six does not give you until year ten in practice; it starts its own shorter countdown the day you find it. Reading and recording a defect early is what protects the option to claim.
