Rental Deposit Disputes in Dubai: How the Process Works

If a Dubai landlord and tenant cannot agree on deposit deductions, the dispute is decided by the Rental Disputes Settlement Centre rather than by either party. What decides these cases in practice is documented evidence of the property condition at the start and end of the tenancy, which is why the check-in record matters far more than the argument itself.

What the deposit is for

Article 20 of Dubai Law No. 26 of 2007 allows a landlord to hold a deposit to guarantee the upkeep of the property, to be refunded at the end of the contract. It is security against damage and unmet obligations, not an additional payment and not a redecoration fund.

What a landlord can reasonably deduct for

  • Damage beyond normal wear and tear, judged item by item.
  • Unpaid rent or utility bills that were the tenant's responsibility under the contract.
  • Cleaning where the property was not returned in a reasonable state.
  • Unapproved alterations, and restoring what was changed without consent.

What a landlord generally cannot do is charge for normal wear and tear, or charge full new-replacement cost for something that was already part-worn at check-in. See wear and tear versus chargeable damage.

The order to do things in

  1. Ask for the deduction in writing, itemised. A specific list is far easier to discuss than a single figure, and it often resolves things on its own.
  2. Compare it against your check-in evidence. Dated photographs and a condition report from move-in day settle most disagreements immediately.
  3. Respond in writing with your evidence. Keep it factual and itemised. Most disputes end here.
  4. If it is still unresolved, file with the Rental Disputes Settlement Centre. Applications are made through the Centre, with Dubai REST as the common digital route. A fee applies and it varies, so check the current position when you file.

What evidence actually carries weight

  • A dated check-in condition report with photographs. This is the strongest single document either side can hold.
  • The tenancy contract, including anything it says about cleaning, painting or the deposit.
  • Written communication about defects reported during the tenancy, which shows what you raised and when.
  • Invoices for work you had done, such as servicing or restoration.
  • Photographs at check-out, taken once the property is empty.

Undated phone photographs with nothing to compare them to are the weakest form of evidence, and unfortunately the most common.

The cheapest dispute is the one that never happens
